Conditions générales de vente (commande orthèse)

1. Objet

Les présentes conditions générales de vente détaillent les droits et obligations de la société Swibrace SA, ci-après dénommée Swibrace, et de ses clients dans le cadre de l’utilisation de l’application de génération de modèles d’appareils orthopédiques anatomiques spécifiques au patient et de leur manufacture.

2. Validité des CGV

Par la finalisation du processus de génération d’attelles ou la création d’un profil sur notre site internet, le client déclare expressément adhérer à ces CGV. L’utilisation de nos services est strictement réservée aux professionnels de la santé et quiconque agrée à ces CGV certifie être titulaire d’un diplôme de médecin, d’orthopédiste ou d’ergothérapeute.

3. Produits

Les produits proposés à la vente par la société Swibrace sont ceux figurant sur tous les supports édités par celle-ci. Toutes manipulations, conditions de stockage ou utilisations contraires aux instructions d’utilisation fournies libèrent Swibrace de toutes responsabilités en cas d’effets non désirés.

4. Livraison

L’envoi des produits ne se limite qu’aux adresses de livraison en Suisse et au Liechtenstein. En cas de répétition de l’expédition pour adresse inexacte, tous les frais de port qui en découlent sont à la charge de l’acheteur. Les cas deforce majeure tels qu'accidents, maladies, incendie, perte de personnel, défauts graves de l'équipement d’impression, etc. libèrent Swibrace de son obligation de respecter le délai de livraison initialement convenu. Le client en sera immédiatement informé et un nouveau délai de livraison sera convenu.

5. Politique d’échange / livraison erronées

En signant le bordereau de livraison, le client accepte les produits livrés. Il est de la responsabilité du client et/ou du réceptionnaire d’effectuer toutes vérifications et de faire toutes réserves à l’arrivée du colis et d’exercer, le cas échéant, tous recours contre le transporteur. A la réception des marchandises, le client doit immédiatement vérifier leur état et leur conformité par rapport au contrat de vente. Toutes réclamations relatives à un défaut des marchandises livrées, à une inexactitude dans les quantités ou à une référence erronée par rapport à la commande confirmée par la société Swibrace, doivent être formulées par écrit dans un délai de 7 jours à réception des marchandises à défaut de quoi le droit de réclamation cessera d’être acquis. Tout retour de marchandises nécessite l’accord préalable du vendeur.

6. Scanner

Un scanner est mis à disposition du client gratuitement sous réserve d’un total de 40 attelles commandées (tous modèles confondus) dans un délai d’un an après son obtention. Le scanner sera récupéré par Swibrace dans le cas où ce quota n’est pas atteint. Durant cette période d’un an à partir de la date d’obtention, il est formellement interdit au client d’utiliser un fichier généré par le scanner ou le scanner en lui- même afin de commander ou participer à l’activité d’un concurrent de Swibrace. Le scanner sera récupéré par Swibrace le cas échéant. Une fois le délai d’un an échu et le quota de commandes atteint, le client devient le propriétaire légal du scanner et peut, par conséquent, en bénéficier à son entière discrétion. Swibrace se réserve le droit de demander réparation en cas de dommage causé au scanner avant la fin de ce délai.

7. Prix

Les prix des marchandises vendues sont ceux en vigueur au jour de la prise de commande. Ils sont libellés en francs suisses et calculés hors taxes. Par conséquent, ils seront majorés du taux de TVA et des frais de livraison applicables au jour de la commande. La société Swibrace s’accorde le droit de modifier ses tarifs à tout moment. Toutefois, elle s’engage à facturer les marchandises commandées aux prix indiqués lors de l’enregistrement de la commande.

8. Paiement

Les factures de Swibrace sont payables sans déduction dans les 30 jours suivant la date de facturation. Les offres et les factures sont établies dans la monnaie nationale suisse CHF. Tous les prix indiqués par Swibrace sont sans TVA.

9. Protection des données

Swibrace respecte la protection des données en particulier en ce qui concerne les données personnelles. Les données fournies à Swibrace seront gardées dans le cadre de l'exécution de la commande, ainsi que pour l'exécution de l'obligation d'archivage et des exigences légales. Dans le cadre du traitement des données sensibles, le client s’engage à informer le détenteur de la donnée du traitement de celle-ci par Swibrace et à recueillir le consentement exprès de ce dernier.

10. Droit applicable et For légal

Les CGV de Swibrace sont soumises au droit suisse exclusivement. Le for est à Fribourg (Suisse), sous réserve de recours au Tribunal fédéral.

These Terms and Conditions will be interpreted and construed exclusively in French. All notices and correspondence will be written exclusively in that language.

These Terms and Conditions, together with our privacy statement and cookie policy, constitute the entire agreement between you and Swibrace SA in relation to your use of this website.
